- Reading Blogs: Access to read blog posts on the Website is free and does not require an account.
- Commenting, Liking, and Content Reporting: To comment on, like blog posts, or submit a formal "Report Blog" request, you must log in using a valid Google account. This credential authentication is strictly enforced to verify user identity, ensure reporting transparency, and mitigate automated spam. You are responsible for maintaining the security of your Google account credentials.
- Writing Blogs: To write and publish blog posts, you must:
- Complete Know Your Customer (KYC) verification as required by NEKTR.
- Authenticate a digital wallet approved by NEKTR.
- Have previously purchased a blog post pack, which provides a set number of blog post instances. Each blog post instance, including writing a blog post and subsequently deleting it, counts as a paid instance and deducts from your purchased blog post pack. Fees are non-refundable.
b. Permitted Use: The Website is intended for personal and commercial use to read, create, and engage with blog content, subject to these Terms and, where applicable, payment of fees. You agree to use the Website only for lawful purposes and in accordance with these Terms.
c. Hyperlinks and Back-Linking: You may include hyperlinks or back-links in your blog posts or User Content, provided they link only to YouTube (https://www.youtube.com) or NEKTR’s official website (https://nektr.co). Links to any other websites or platforms are strictly prohibited unless expressly authorized by NEKTR in writing.
d. Prohibited Conduct: You may not:
- Use the Website in any way that violates applicable laws or regulations.
- Post or transmit content that is unlawful, defamatory, obscene, threatening, harassing, or otherwise objectionable.
- Abuse the "Report Blog" feature by knowingly filing false, fraudulent, malicious, or bad-faith takedown reports against other creators.
- Include hyperlinks or back-links to any websites other than YouTube or Nektr.co without prior written consent.
- Attempt to gain unauthorized access to the Website, its servers, or any connected systems.
- Use automated systems (e.g., bots, scrapers) to access or collect data from the Website without our prior written consent.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Interfere with or disrupt the Website's functionality or security.
- Attempt to bypass KYC or wallet authentication requirements for writing blogs.
3. User Content
a. Submissions: The Website allows you to create and submit blog posts, comments, or other content (“User Content”), subject to the access requirements in Section 2(a). By submitting User Content, you grant NEKTR a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, and distribute such content in connection with the Website, including for promotional or commercial purposes.
b. Responsibility: You are solely responsible for your User Content. You represent and warrant that your User Content does not infringe on any third-party rights (e.g., copyright, trademark, privacy) and complies with these Terms, including the hyperlinking restrictions.
c. Content Removal & Review: NEKTR reserves the right, but not the obligation, to review, edit, or remove any User Content, including blog posts or comments, at our sole discretion, without notice, if it violates these Terms, contains unauthorized links, or is flagged via our reporting tools and deemed inappropriate. Removal of User Content does not entitle you to a refund of any fees paid for the associated blog post instance or pack.
4. Intellectual Property
a. Ownership: All content on the Website, including text, images, logos, and design elements (excluding User Content), is owned by NEKTR or its licensors and is protected by copyright, trademark, and other intellectual property laws.
b. Limited License: NEKTR grants you a limited, non-exclusive, non-transferable, revocable license to access, view, and, where authorized, create content on the Website for personal or commercial use, subject to these Terms and payment of applicable fees. You may not copy, reproduce, distribute, or create derivative works from the Website’s content (excluding your own User Content) without our prior written consent.
5. Third-Party Services and Analytics
a. Restricted Administrative Access: Access to log in, authenticate accounts, or modify platform properties is strictly limited to authorized network administrators. Public user accounts, comment features, and liking mechanisms are disabled for standard visitors.
b. c. Traffic Attribution and Metrics: To monitor unique visitor metrics and maintain service integrity without forcing user registration, the platform generates a localized device fingerprint profile. This data string is immediately hashed, anonymized, and stored securely to prevent identification while accurately mapping performance analytics.
6. Disclaimer of Warranties
The Website is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. NEKTR does not guarantee that the Website will be uninterrupted, error-free, or free of viruses or other harmful components, nor does it guarantee the availability or security of third-party services like Google accounts or digital wallets.
7. Limitation of Liability
To the fullest extent permitted by law, NEKTR, its affiliates, officers, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Website, including any commercial activities, loss of User Content, decisions made regarding reported content, or issues with third-party services (e.g., Google accounts or digital wallets), even if advised of the possibility of such damages. In no event shall NEKTR’s total liability to you exceed the amount you paid for the specific blog post pack giving rise to the claim, or $100, whichever is greater.
8. Indemnification
You agree to indemnify, defend, and hold harmless NEKTR, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Website, your User Content, your validation or misuse of the reporting tools, your violation of these Terms, your commercial activities, or your use of third-party services like Google accounts or digital wallets.
9. Termination
NEKTR may suspend or terminate your access to the Website, including your ability to comment, like, or submit blog reports, at any time, with or without cause, and with or without notice, if we believe you have violated these Terms (including but not limited to posting unauthorized links, filing fraudulent content reports, posting objectionable content, or failing KYC/wallet authentication) or for any other reason at our discretion. Termination does not entitle you to a refund of any fees paid for blog post packs.
10. Privacy
Your use of the Website, including KYC, wallet authentication, and Google verification profiles used for interaction or content reporting, is subject to our Privacy Policy, available at /privacy-policy, which describes how we collect, use, and protect your personal information. The Privacy Policy is incorporated into these Terms by reference.
11. Security & Access
We reserve the right to restrict or suspend access to our services (including account access and API usage) if we detect suspicious, abusive, or unauthorized activity. This includes, but is not limited to, repeated failed login attempts, automated scraping, denial-of-service patterns, malicious high-volume content reporting, or attempts to bypass security controls.
12. IP Blocking & Account Bans
Continued violations of our security policies or terms will result in permanent infrastructure blocking strategies. We employ automated system triggers to deploy firewall constraints, blocking malicious IP clusters and blacklisting bad-actor accounts globally.
13. Fair Use
You agree not to overload our servers, abuse APIs, or attempt unauthorized access. We may limit request rates, enforce CSRF protections, and restrict high-risk traffic at our discretion.
14. Governing Law and Dispute Resolution
a. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
b. Dispute Resolution: Any disputes arising from or related to these Terms or your use of the Website shall be resolved through binding arbitration in Wilmington, Delaware, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.
